1. Acceptance of Terms

Welcome to Best4Host. By accessing our website, purchasing our products, or using our services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you ("Client," "User," or "You") and Best4Host ("Company," "We," "Us," or "Our"). If you do not agree to these Terms, you must not access or use our Services.

We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the Services after any changes indicates your acceptance of the new Terms.

2. Account Registration and Security

To access certain features of our Services, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for maintaining the confidentiality of your account credentials, including your password. You agree to notify us immediately of any unauthorized use of your account or any other breach of security. Best4Host will not be liable for any loss or damage arising from your failure to comply with this section.

3. Use of Services

3.1 Acceptable Use Policy (AUP)

You agree to use our Services only for lawful purposes. You are strictly prohibited from using our Services to:

  • Host, transmit, or distribute any material that infringes on the intellectual property rights of others (e.g., copyright, trademark).
  • Distribute malware, viruses, trojans, worms, or any other malicious code.
  • Host phishing sites or engage in fraudulent activities.
  • Launch Denial of Service (DoS) or Distributed Denial of Service (DDoS) attacks against any network or system.
  • Send unsolicited bulk emails (SPAM).
  • Host child pornography or any content that exploits minors.

Violation of this AUP may result in immediate suspension or termination of your account without refund.

3.2 Resource Usage

Shared and VPS hosting accounts are subject to resource limits (CPU, RAM, Disk I/O). You agree not to excessively consume resources in a way that negatively impacts the performance of the server or other users. We reserve the right to temporarily suspend or limit resources for accounts exceeding these thresholds.

4. Payment, Billing, and Refunds

4.1 Billing

Services are billed in advance on a recurring basis (monthly, quarterly, annually, etc.) depending on the billing cycle you choose. Invoices are generated 7-14 days before the due date. Failure to pay by the due date may result in service suspension. Accounts overdue by more than 7 days may be terminated, and data may be permanently deleted.

4.2 Refund Policy

We offer a 30-day money-back guarantee for new hosting accounts. If you are not satisfied with our services within the first 30 days, you may request a full refund. This guarantee applies to shared and VPS hosting plans only. Dedicated servers, domain registrations, software licenses, and setup fees are non-refundable.

Refunds are not available for accounts suspended or terminated due to violations of our Terms of Service or Acceptable Use Policy.

4.3 Price Changes

We reserve the right to change our prices at any time. Any price changes will be communicated to you at least 30 days in advance and will take effect upon your next renewal period.

5. Content and Data Backups

You retain full ownership of all content and data you upload to our Services. However, you grant us a worldwide, royalty-free license to host, store, copy, and display your content as necessary to provide the Services to you.

You are solely responsible for maintaining backups of your data. While we may perform courtesy backups for disaster recovery purposes, we do not guarantee the availability or integrity of these backups. Best4Host shall not be liable for any loss of data, whether due to hardware failure, human error, or any other cause. We strongly recommend that you maintain your own off-site backups.

6. Service Level Agreement (SLA)

We guarantee a 99.99% network uptime. If we fail to meet this guarantee in any given month, you may be eligible for service credits as outlined in our SLA Policy. The SLA does not cover downtime caused by scheduled maintenance, client error, or force majeure events.

7. Limitation of Liability

To the fullest extent permitted by law, Best4Host and its directors, employees, partners, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Services; (ii) any conduct or content of any third party on the Services; (iii) any content obtained from the Services; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.

8. Indemnification

You agree to defend, indemnify, and hold harmless Best4Host and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Services or your violation of these Terms.

9. Termination

We may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. Upon termination, your right to use the Services will immediately cease. If you wish to terminate your account, you may simply discontinue using the Services or contact our support team to request cancellation.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of the jurisdiction in which Best4Host is registered, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
